Vacancy: Executive Director

The Anti-Counterfeit Agency (ACA) is a State Corporation in the Ministry of Industrialization and Enterprise Development (MOIED). It was established by the Anti-Counterfeit Act No. 13 of 2008 and became operational on 1st June 2010.

The Anti-Counterfeit Act, Section 5, stipulates the specific functions of the Agency as follows:

  1. Enlighten and inform the public on matters relating to counterfeiting;
  2. Combat counterfeiting, trade and other dealings in counterfeit goods;
  3. Devise and promote training programs to combat counterfeiting;
  4. Co-ordinate with national, regional or international organizations involved in combating counterfeiting;
  5. Carry out any other functions prescribed for it under any of the provisions of this Act or under any other written law; and
  6. Perform any other duty that may directly or indirectly contribute to the attainment of the foregoing.
The Agency wishes to fill competitively the position advertised below to enhance the achievement of her mandate and the realization of its vision by having a substantive Executive Director.

Job Description: The Executive Director shall be responsible to the Board in the day-to-day running of the affairs of the Agency, in the supervision of inspectors and in the implementation of the Anti-Counterfeit Act.

The Executive Director will be answerable to the Board of Directors and will:-

  • Be responsible for the day-to-day operations of the Agency;
  • Ensure the implementation and management of the Agency’s vision, mission, set goals and objectives;
  • Identify, formulate and recommend strategic issues to the Board; Administering the Anti-Counterfeit Act, 2008 and the Subsidiary Legislation made there under;
  • Provide leadership to senior management and staff;
  • Ensure that the Agency has an effective management structure including succession plans;
  • Develop and recommend to the Board the annual business plans for the Agency;
  • Prepare the annual budgets and establish proper internal controls;
  • Be responsible for the execution and communication of the Board’s strategies, decisions and policies;
  • Serve as the link between the Board and the Management;
  • Ensure that all Board papers are accurately written, are relevant and are availed to the Board members in good time;
  • Provide regular, thorough and prompt communication to the Board on key technical, financial and administrative matters;
  • Be responsible for stakeholder management and the enhancement of the corporate image of the organization;
  • Initiate and cause appropriate steps to be taken against infringement of intellectual property rights for which complaint has not been lodged by the intellectual property owner;
  • Ensure that policy matters of the Agency are in line with those of Government generally and in particular concerning counterfeiting; and
  • Perform any other duty as may be required by the Board in accordance with the Anti- Counterfeit Act, 2008 any subsidiary legislation made there under and any other written law.
Job Specifications
For appointment to the position of Executive Director, a person must have:
  • a Masters degree in Law, Science, Social Science, Information Technology, Business Administration or its equivalent from a recognized institution;
  • a Bachelor’s degree in Law, Science, Social Science, Information Technology or Business Administration or its equivalent from a recognized institution;
  • served for at least six (6) years in the grade of Deputy Director OR ten (10) years working experience in matters relating to trade or industry;
  • demonstrated managerial, administrative and professional competence in work performance;
  • Working knowledge of the procedures and processes of Public sector and experience in working in a public institution;
  • Proven technical expertise in policy analysis and good understanding of industrial development issues;
  • attended a Strategic Leadership Development Program including a corporate governance training lasting for at least five days;
  • must be a member of a relevant recognized professional body;
  • Good writing, analytical, oral and presentations kills;
  • Computer literate;
  • a course in Intellectual Property Rights or criminal prosecution of intellectual property right matters will be an added advantage;
  • Relevant experience and knowledge on counterfeiting matters shall be an added advantage;
  • a PhD will be an added advantage.
