Terms of Reference

Desk Review on the Status and Implementation of Policies and Laws on Child Protection in Ethiopia, Kenya, Sudan and South Sudan, Rwanda Tanzania and Uganda 

Background

ANPPCAN is a pan-African child rights organization concerned with the status of children in general, and, in particular, those in need of protection.

It was founded in 1986 in Enugu, Nigeria during the First African Conference on Child Abuse and Neglect whose theme was Child Labour in Africa.

It is registered as an international NGO in Kenya and has its headquarters in Nairobi, Kenya and also has observer status with the African Union (AU) and the African Commission on Human and Peoples Rights based in Banjul, Gambia.

ANPPCAN seeks to engage the services of a consultant to conduct a desk review on the status and implementation of policies, laws and practices on child protection in 7 countries in the Eastern Africa region, namely Ethiopia, Kenya, Sudan, South Sudan, Rwanda, Tanzania and Uganda.

In October 2011, ANPPCAN Regional Office with support from Save the Children Sweden conducted a desk review of child protection systems in the above mentioned countries.

The report indicated that various countries are at a variance in the ratification and implementation of international instruments specifically the United Nations Convention on the Rights of the Child (UNCRC) and the African Charter on the Rights and Welfare of the Child (ACRWC).
The same review also noted that although most governments in Eastern and other parts of Africa are signatories to the international and regional instruments on child rights and protection, most of these countries have still to develop a coherent National Child Protection System (NCPS).
The review further noted that despite their efforts to domesticate, especially the UNCRC and ACRWC in the 7 targeted countries, implementation of the enacted and developed laws and policies remain a challenge which these countries are still grappling with.

This review also revealed that in the countries targeted, legal provisions dealing with children are scattered throughout various pieces of legislation and lack political will to implement.

Following the recommendations of the 2011 study, ANPPCAN Regional Office engaged a consultant in 2012 to develop and refine a regional strategy on National Child Protection systems in Eastern Africa Region.

The strategy highlighted 5 key objectives including strengthening the legal and regulatory environment, improving the resource base for national child protection systems, strengthening the national institutions to play a leading role in lobbying; policy development and resource mobilization; supporting research; data management and dissemination, and supporting intra country learning and experience sharing.
The regional strategy was shared and validated by participants from the 7 countries during the regional planning meeting that took place in July 2013.

It is against this back drop that a desk review of laws, policies and practices in relation to international standards and protocols in the 7 Eastern Africa countries will be conducted as part of the implementation of the Strategy.

Scope of Work

To conduct a desk review on laws and policies that exist in the 7 countries, namely Ethiopia, Kenya, Sudan, South Sudan, Rwanda, Tanzania and Uganda.
The consultant will lead the process of reviewing policies and laws that will improve and strengthen the legal and regulatory environment for effective NCPS. Support will be given to the lead consultant by Technical Working Groups (TWGs) and Focal points in the form of gathering and consolidating country legal documents for review that are in line with child protection.
The TWGs through their focal points will link up with the ongoing processes regarding the NCPS in the implementation of laws and policies in their respective countries then to feed the consultant.
The consultant will undertake the following in the 7 targeted countries:
  • Develop an outline, frame work and methodology of the desk review on the status and implementation of laws, policies and practices on child protection.
  • Conduct a comprehensive desk review and analysis of the status and implementation of laws and policies and practices on child protection.
  • Identify existing gaps and challenges faced in the implementation of laws and policies on child protection in the 7 countries.
  • Identify good practices in implementing laws, policies and practices that exist in the target countries for possible replication
  • Determine political will and the potential support and capacity of State and Non state actors to implement laws and policies on Child protection in the target countries.
  • Produce a draft report on review
  • Prepare a final report with concrete recommendations and conclusions on how to improve the implementation of different pieces of legislation and policies that protect children.
Methodology
  • The consultant will undertake a desk review using all the available information in the target countries.
  • He/she will work with the TWGs based in the 7 countries who will consolidate relevant legal and policy documents for review.
  • The consultant will also undertake some focused discussions with significant groups on same in some countries where need be, e.g. the members of TWGs in respective countries.
Deliverables
The outputs of this project will be:
  • A draft outline of the Desk Review including the methodology to be used.
  • A draft desk review report
  • A final desk review report on the status and implementation of laws and policies on Child protection in Eastern Africa Region.
Time Frame
The desk review will take 10 days.
The first draft report of the findings of the study will be submitted to ANPPCAN Regional by 4th week of September 2013.
ANPPCAN together with the Technical Working Groups will give their comments within a week for the consultant to refine and enrich the report.
The final draft of the report should be submitted by 2nd week of October 2013 after incorporating comments from the Technical Working Groups in the 7 countries.

Consultant Skills and Experience 

  • A minimum of Masters Degree in Law, Governance, Human Rights, Social Sciences, Development Studies, Political Science or related discipline.
  • Broad knowledge and understanding of key legal, policy documents and international instruments for child protection
  • Previous experience on carrying out similar work that is Regional/International in scope preferably in Africa
  • Experience in legislative and policy review on similar issues
  • Experience of working with Technical Working Groups/Teams
Highly Desirable
  • Knowledge of National Child Protection Systems in Eastern Africa Region
  • Experience of working with partners at international, regional and national levels.
